Consignment Agreement

1. Term of Agreement

This Agreement shall commence on the date signed below and remain in effect for 90 days from the date of item acceptance, unless otherwise agreed in writing.

2. Authorization to Sell

The Consignor authorizes the Consignee to sell all items described in this Agreement and any addendums. All consigned items are available for sale while in the Consignee’s possession.

3. Item Acceptance

The Consignee will accept selected items for consignment based on condition, market appeal, and style. Acceptance is at the sole discretion of the Consignee. All items must be clean, damage-free, and ready for resale. The Consignee will set the initial retail price in consultation with the Consignor, based on market trends and professional assessment.

4. Payment Terms

Payments will be issued via ACH direct deposit on or around the 10th of each month for the prior month’s sales. Checks may be issued upon request, there will be a $2.00 check fee.

5. Unsold Items

After 90 days, the Consignee reserves the right to donate or liquidate any remaining inventory if not collected by the Consignor within 7 business days of notification unless other arrangements are agreed to in written form by Consignor.

6. Commission

• The Consignor will receive 50% of the final selling price, including after any discounts or markdowns.

• For items sold above $2,500, the Consignor will receive 60% of the final sale price.

7. Pricing & Discounts

The Consignee may accept reasonable offers at any time. Consigned items are subject to the following price reductions, which affect the Consignor’s earnings:

• 15% reduction after 30 days

• 25% reduction after 60 days

• 40% reduction after 75 days

• 50% or greater reduction after 90 days

8. Early Item Removal

If the Consignor wishes to remove an item early, they must pay 25% of the original asking price.

9. Liability

The Consignee is not responsible for any damage, theft, or loss of consigned items. While reasonable care will be exercised in displaying and handling items, the Consignee is not liable for loss due to fire, flood, theft, or other unforeseen events.

10. Unclaimed Earnings

Unclaimed Consignor earnings will be forfeited 6 months after the expiration of this Agreement.

11. Item Condition

All items must be in very good to excellent condition. The Consignee may charge the Consignor a fee for any necessary cleaning or repairs.

12. Consignment Status

The Consignor may view sold items through the online portal. The portal only displays sold items. For updates on active consignments, the Consignor is encouraged to communicate directly with the Consignee.

13. Ownership & Legal Rights

The Consignor affirms they are the legal owner of all consigned items and have full authority to consign them. Title remains with the Consignor until the item is sold.

14. Termination

Either party may terminate this Agreement at any time with written notice. Upon termination, any unsold items must be retrieved within 7 business days of termination, early item removal fee to consigner applies.

15. Pick-Up & Delivery

Pick-up or delivery of items can occur at our showroom, or via arranged transportation with the Consignee.
